Victorian councils have the broad power to make local laws for or with respect to any act, matter or thing in respect of which the council has a function or power under the Local Government Act 2020 or any other Act.
Wellington Shire Council currently has two local laws: Local Law No. 1 – Processes of Municipal Government and Community Local Law 2021.
Local Law No. 1 is due to sunset (in other words, expire) on 20 October 2024 – ten years after the day the local law came into operation. A local law is required to create offences for non-compliance with Council’s Governance Rules.
Proposed Governance Local Law 2024
On 16 April 2024, Wellington Shire Council resolved to make the proposed Governance Local Law 2024 available for community engagement.
The objectives of the proposed local law are to:
Regulate the use of the common seal;
Prohibit unauthorised use of the common seal or any device resembling the common seal and determine offences and associated penalties;
Determine offences and associated penalties relating to conduct at Council Meetings;
Provide for the administration and exercise of Council powers and functions; and
Revoke any redundant Local Laws.

A Community Impact Statement has also been developed to inform the community about the proposed Local Law and to assist any members of the public who may wish to participate in the community engagement process. This can be found in the 'Key Documents' tab under Community Impact Statement.
