What is Amendment C122well?

This amendment proposes to apply a Public Acquisition Overlay (PAO2) to parts of three properties within the North Sale growth area.

The amendment will allow Wellington Shire Council to compulsorily acquire a 10 metre strip of land north of Cobains Road, Sale, for the purposes of allowing upgrades for the growth area, including:

  • Road widening;
  • Underground infrastructure; and
  • Shared pedestrian pathways

This requirement has been identified within the North Sale Development Plan (2018) and North Sale Infrastructure Funding Arrangement (November 2022).

An approximated land total of 3,000m2 is required. As the area exceeds 10% (or 10% of the total value) of the total area of the individual allotments, the Land Acquisition and Compensation Act 1986 specifies that the land must be reserved through the application of a Planning Overlay called a Public Acquisition Overlay Schedule 2 (PAO2), to ‘reserve’ the land for future acquisition.

The 10 metre strip of land required for public acquisition is located within 37A, 49 and 65 Cobains Road, Sale. The land required to be acquired is highlighted in light green below, running parallel to Cobains Road (see Figure 1).

What does Amendment C122well do?

The amendment will allow Wellington Shire Council to compulsorily acquire land to facilitate the delivery of the North Sale Development Plan (2018) and North Sale Infrastructure Funding Arrangement (November 2022).

The amendment proposes to make the following changes to the Wellington Planning Scheme:

Overlay Maps

  • Inserts Planning Scheme Map No. 90PAO, to show PAO2 applying to the land to be acquired.

Planning Scheme ordinance

  • Amends the schedule to Clause 72.03 – What does this planning scheme consist of? to reference planning scheme map number 90PAO.

Current stage: exhibition

Public exhibition will run from 20 November 2025 to 22 December 2025.

Any person who may be affected by the amendment may make a submission to the planning authority. Submissions must be made in writing clearly stating the grounds on which the amendment is supported or opposed and indicating what changes (if any) the submitter wishes to make.

Name and contact details of submitters are required for Council to consider submissions and to notify such persons of the opportunity to attend Council Meetings and any public hearing held to consider submissions.

The closing date for submissions is 22 December 2025.
